Appeal denied for man sentenced to death in Escambia County murder
The Florida Supreme Court has denied a killer's appeal from death row.
Michael Zack was sentenced to death for the 1996 murder of Ravonne Kennedy Smith in Escambia County.
Justices agreed with a lower court that he doesn't qualify for relief based on an intellectual disability.
His lowest IQ is 79, which is above the threshold.
Zack is also asked for a new sentence because jurors weren't unanimous for the death sentence.
Justices ruled that his case doesn't qualify because he was tried before the unanimous requirement was set.
