Juvenile inmates arrested for trying to sodomize another boy with "Pert" shampoo bottle

A disturbing altercation at the juvenile justice center is under investigation in Walton County.

According to a report, a male victim was watching television on a couch at the Florida Department of Juvenile Justice Walton Academy for Growth and Change located in DeFuniak Springs, Florida on July 5th when Walter Harvey, Winter Haven, Florida, and Brian Burton, of West Park, Florida, picked him up and carried him to a cell where two other juvenile inmates, Berkley Bell, Daytona Beach, Florida, and DeQuan Myers, of Tampa, Florida, were waiting in an empty room.

Next, the “co-defendants…forced the victim face down on a bed, pulled his pants down and tried to penetrate him with a “Pert” trial sized shampoo bottle, the report outlines.

According a report, an employee, Antoine Davis, of Crestview, is seen on surveillance video and by a witness unlocking the cell doors where the incident happened moments before and it shows he returned “watching as the incident unfolds” and reportedly “laughing”.

The victim, who is said to be over 12-years-old but under 16-years-old, managed to escape and became upset, the report states.

According to the report, the victim approached 27-year-old Davis in the common area as he was writing the victim a direct referral for throwing items after the assault, and Davis snatched him” onto a table.

On July 6th, the four juveniles were arrested.

The Florida Department of Juvenile Justice released this statement regarding the incident that occurred at Walton Academy for Growth and Change.

The Florida Department of Juvenile Justice (DJJ) was notified by our contracted provider for Walton Academy for Growth and Change of an incident that occurred at the program. Law enforcement was immediately notified and DJJ’s Office of Inspector General is currently investigating this incident. DJJ does not tolerate this type of behavior and the contracted staff person involved in the incident has been terminated. Their actions are inexcusable and it is our expectation that they be held accountable to the fullest extent of the law. We would like to thank the Walton County Sheriff’s Office for their immediate response and we stand ready to assist them in any way.

Berkley Bell, DeQuan Myers and Brian Burton, all 17-years-old, are charged with one count of lewd and lascivious behavior and one count of kidnapping/false imprisonment. Walter Harvey, 16, faces the same charges.

On July 12th, a juvenile inmate came forth confirming Antoine David watched the four juveniles forcibly hold the victim down and try and “stick something up his a**”, the report states.

“By Mr. Davis opening the doors and leaving them unattended he committed a direct violation of the facility policy and procedure” the report states.

Davis was arrested on July 12th on charges of lewd and lascivious battery and promoting sexual activity on a victim less than 16, false imprisonment, and battery.

The facility is run by Rite of Passage, Inc. who is contracted through the Department of Juvenile Justice to provide a secure residential treatment program for males, ages 13 to 18.

The investigation is ongoing.
